This course explores common risks associated with operating a brokerage and practicing real estate sales, with a focus on identifying potential liability and understanding the steps licensees and brokers can take to minimize risk. Participants will examine risk-management considerations related to short sales, brokerage policy manuals, escrow, agency relationships, rebates, kickbacks, and Florida real estate requirements. Learning Objectives: After taking this class, participants will be able to: • Identify the essential components of an effective brokerage policy manual. • Identify issues that present significant liability risks for real estate professionals and brokerages. • Create a table of contents for a brokerage policy manual. • Distinguish areas of risk between a salesperson and a brokerage in specific scenarios. • Identify appropriate steps for meeting applicable Florida Statutes Chapter 475 requirements. • Define the agency options available to Florida real estate licensees. • Identify the steps and timeline requirements for filing an escrow disbursement request with the Division of Real Estate. • Distinguish between illegal kickbacks and legal rebates. • Define key real estate and regulatory acronyms, including HUD, RESPA, ADA, FTC, and FS 475.
